ISLAMABAD (MNN); The Federal Constitutional Court (FCC) on Tuesday summoned the complete record of cases pending before the Supreme Court concerning the transfer of PTI founder Imran Khan to Shifa International Hospital.
The three-member FCC bench, headed by Chief Justice Aminuddin Khan and comprising Justices Ali Baqar Najafi and Aamer Farooq, also sought records of similar cases heard by high courts.
The records were summoned under Article 175-E, introduced through the 27th Constitutional Amendment, which empowers the FCC to call for case records involving major constitutional questions.
The matter arose from a petition by three Adiala jail inmates—Muhammad Ilyas Khan, Mohammad Ismail Hussain and Owais Altaf—seeking medical facilities similar to those granted to Imran Khan by the Supreme Court in its August 18 order.
The SC had directed the government to shift Imran to Shifa International Hospital for examination and treatment by a multidisciplinary medical board.
Attorney General Mansoor Usman Awan argued that following the 27th Amendment, constitutional interpretation and fundamental-rights matters now fall within the FCC’s jurisdiction. He urged the court to summon the SC record.
Chief Justice Aminuddin Khan observed that the Constitution and law must apply equally to the rich and poor.
The FCC adjourned the hearing after summoning the records, without fixing a date for the next hearing. The development came a day before the SC was scheduled to resume proceedings concerning Imran Khan’s health.
